Terms of Use

These Terms of Use ("Terms") govern your use of ERETZIA — the website, the mobile app and every service they offer (together, the "Platform"). By creating an account, or by using the Platform, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Platform.

1. What ERETZIA is — and is not

ERETZIA is an online marketplace that helps people find property in Tanzania and connects them with the owners and agents who list it ("Listers").

• ERETZIA is not a party to any sale, lease or rental. Any agreement is made directly between you and the Lister. ERETZIA is not a real estate agent, broker, landlord, seller, lawyer or valuer, and does not hold deposits or rent for anyone.
• Listings are written by Listers. Listers are responsible for what they publish: the description, price, photos, availability and terms.
• Verification reduces risk, it does not remove it. Before a listing goes live, our team checks the items shown on its verification page — for example ownership documents, identity, location, photos and availability. These checks are made in good faith from the documents and information provided at the time. They are not a legal title search, a survey, a valuation or a guarantee. You remain responsible for your own checks before paying anything or signing anything.

2. Your account

• You must be at least 18 years old and able to enter into a binding agreement.
• Give accurate information and keep it up to date. One person or business per account.
• Keep your password secret. You are responsible for what happens under your account. Tell us at once if you think someone else has used it.
• We may ask you to confirm your email address or phone number before using some features.

3. Rules for everyone

You must not:

• publish, send or upload anything false, misleading, fraudulent, defamatory, discriminatory, obscene or unlawful;
• list property you do not own or are not authorised to list, or use another person's photos, documents or identity;
• ask for or take any payment, deposit or "viewing fee" before the customer has seen the property and signed an agreement;
• harass, threaten or spam other users, or use their contact details for anything other than the listing you are discussing;
• copy, scrape or harvest listings or user data, or try to access areas, accounts or systems you are not allowed to;
• interfere with the Platform's security or operation, or upload malicious code.

4. Rules for Listers (owners and agents)

• You confirm that you own the property, or have the owner's written authority to list it, and that everything in the listing and the documents you upload is true, current and yours to share.
• Keep availability accurate: mark a listing reserved, sold or rented promptly.
• You give ERETZIA a non-exclusive, royalty-free licence to host, display, adapt (for example resize photos) and promote your listing content on the Platform and in ERETZIA's marketing while the listing is live, and to keep records of it afterwards.
• Verification documents are used only to check the listing (see the Privacy Policy). Uploading a document does not guarantee approval; we may reject, suspend or remove any listing at our discretion.

5. Paid features

Where paid plans or featured listings are offered, their price, duration and what they include are shown before you pay. Payments are processed by our mobile-money payment provider. Unless the law requires otherwise, fees for time already used are not refundable. We may change prices for future purchases at any time.

6. Messages, viewings and alerts

The Platform lets customers and Listers message each other, arrange viewings and receive alerts. Keep conversations on the Platform where you can: it helps us protect you and investigate reports. Alerts and notifications are sent on a best-effort basis and may be delayed or not delivered.

7. Search and recommendations

Search results, match scores and recommendations are generated automatically from the information in listings and what you tell us. They are suggestions only and may be incomplete or inaccurate.

8. Reporting and enforcement

Report any listing, message or user you believe breaks these Terms. We may investigate, remove content, limit features, suspend or close accounts, and share information with the authorities where the law allows or requires — with or without notice, especially where fraud or harm is suspected.

9. Intellectual property

The ERETZIA name, logo, design, software and content (other than content provided by users) belong to ERETZIA and are protected by law. You may not use them without our written permission.

10. Disclaimers

The Platform is provided "as is" and "as available". To the fullest extent permitted by law, ERETZIA makes no promises that the Platform will be uninterrupted or error-free, or that any listing, Lister, customer or property is accurate, lawful, available, safe or suitable for you.

11. Limitation of liability

To the fullest extent permitted by law, ERETZIA and its team are not liable for any loss arising from: any agreement, payment or dispute between users; the condition, title, legality or availability of any property; content published by users; your reliance on verification, search results or recommendations; or any indirect or consequential loss, loss of profit or loss of data. Where liability cannot be excluded, ERETZIA's total liability to you is limited to the fees you paid to ERETZIA in the six months before the claim, or TZS 100,000 if you paid nothing. Nothing in these Terms limits liability that cannot be limited by law.

12. Indemnity

You agree to compensate ERETZIA for any claim, loss or cost (including reasonable legal fees) arising from your content, your listings, your dealings with other users, or your breach of these Terms or the law.

13. Ending your use

You may stop using the Platform and ask us to close your account at any time. We may suspend or close accounts under section 8. Sections that by their nature should continue (for example 4, 9, 10, 11, 12 and 14) continue after your account ends.

14. Governing law and disputes

These Terms are governed by the laws of the United Republic of Tanzania. We encourage you to contact us first so we can try to resolve any complaint. Disputes that cannot be resolved informally will be decided by the competent courts of Tanzania.

15. Changes to these Terms

We may update these Terms. We will show the new version on this page with its date and, for important changes, ask you to accept it before you continue using the Platform. The version you accepted, and when, is recorded on your account.
